Terms of Use
These terms are a contract between you and Pelik Eğitim ve Danışmanlık Ltd. Şti., a company registered in Türkiye ("we", "us") for the use of the 4S Gump mobile application and website (the "Service"). By creating an account you accept them. If you do not agree, do not use the Service.
1. What the Service is
4S Gump is a self-study tool for English language exams such as IELTS, Cambridge C1 Advanced (CAE) and PTE Academic. It offers practice tasks for speaking, writing, reading and listening, grammar and vocabulary quizzes, timed mock exams, and feedback generated by artificial-intelligence services. We are not affiliated with, endorsed by, or acting for the organisations that run these exams. IELTS, Cambridge and PTE are trademarks of their respective owners.
2. Your account
- You must be at least 13 years old, or the minimum age for digital consent where you live, to create an account.
- Give accurate information, keep your password private, and tell us at once if you think your account has been used without permission.
- One account per person. You are responsible for everything done through your account.
- You can delete your account at any time in the app (Account → Delete account). Deletion is permanent and removes your progress.
3. Free content and subscriptions
- The first exercise in each module is free. Everything else requires a paid subscription.
- Subscriptions are monthly and renew automatically at the price shown in the app until you cancel. They are sold and billed by Apple (App Store) or Google (Google Play), not by us directly, under their terms.
- Your account is charged at confirmation of purchase and again at the start of each renewal period unless you cancel at least 24 hours before the period ends.
- Cancel or manage a subscription in your App Store or Google Play account settings; deleting the app or your 4S Gump account does not cancel it.
- Refunds are decided by Apple or Google under their refund policies; we cannot issue refunds for purchases made through the stores.
- Prices may change; a change applies from your next renewal and is announced in advance as the stores require.
- What each subscription includes is described in the app at the time of purchase. We may change the content offered inside a subscription while keeping its overall scope.
4. AI-generated feedback is guidance, not a result
Scores, band estimates, corrections and model answers are produced by automated systems. They are estimates meant to help you practise. They are not official exam results, do not predict the score any examining body will give you, and may contain errors. Check anything important against official exam materials.
5. Acceptable use
Do not: share your account or resell access; copy, scrape, or redistribute the exercises, recordings or feedback; reverse-engineer the app or try to bypass paywalls, rate limits or security; upload unlawful, abusive or infringing content in tutoring questions or profile photos; or use the Service to build a competing product or to train AI models. We may suspend or close accounts that break these rules.
6. Your content
You keep the rights to what you write, say or upload. You give us a licence to store and process it only to provide the Service (for example, sending a recording for transcription and scoring), as described in our Privacy Policy. We do not use your content to train AI models or for advertising.
7. Our content
The app, its design, exercises, audio, images, videos, model answers and software are owned by us or our licensors and protected by copyright and other laws. You get a personal, non-transferable, revocable licence to use them for your own exam preparation. Nothing here transfers ownership to you.
8. Availability and changes
We work to keep the Service available but do not guarantee uninterrupted access; it depends on third-party providers (hosting, speech and AI services, app stores) that can fail or change. We may add, change or remove features, exams or content, and may end the Service with reasonable notice. If we end it while you have an active subscription, the stores' refund rules apply.
9. Termination
You can stop using the Service and delete your account at any time. We may suspend or terminate your access if you breach these terms, if required by law, or if we discontinue the Service. Sections 4, 6, 7, 10 and 11 survive termination.
10. Disclaimer and limitation of liability
The Service is provided "as is". To the extent the law allows, we exclude all warranties and are not liable for indirect or consequential losses, lost exam opportunities, or damages arising from reliance on AI feedback. Where liability cannot be excluded, it is limited to the amount you paid for the Service in the twelve months before the claim. Nothing in these terms limits rights you have as a consumer under mandatory law, including the Turkish Consumer Protection Law No. 6502.
11. Governing law and disputes
These terms are governed by the laws of the Republic of Türkiye. Disputes are heard by the ‹OWNER: courts, e.g. Istanbul (Çağlayan) Courts and Enforcement Offices›, without prejudice to your right as a consumer to apply to the consumer arbitration committees and consumer courts where you live.
12. Changes to these terms
We may update these terms. The effective date shows the current version; material changes are announced in the app before they take effect. Continuing to use the Service after that date means you accept the new terms.
